The following are the terms and special conditions for usuary members of dogup.com (henceforth to be known as Members) applicable to the use of the Web Site described as http://www.dogup.com. Any Member that wishes to accede and/or to use dogup.com, will be able to do so after agreeing to these Terms and Special Conditions, and to the applicable legal dispositions.

1.- Definition of Member

The use of dogup.com attributes in each case the quality of generic user (henceforth to be known as the "User") and his or her behavior will have to conform according to the Terms and General Conditions (to put Link).

In order to obtain the title of Member, the User will have to read and to accept the present Terms and Special Conditions, and to govern his or her conduct on the basis of such while using and navigating within dogup.com.

The Member will have to brief the data that are required of him or her in the recording form. The information that he or she provides will be kept completely confidential.

It is obligatory to complete the recording form in all its fields with valid data. This data will be intended for the suitable benefit of the different services that dogup.com offers, as well as the to inform the Member of promotions, supplies and commercial information related to dogup.com.

Due certainty is left that dogup.com has a data base comprised of this data, to the indicated effects.

Consequently, the Member specifically accepts and allows the use of his or her data for the predicted aims.  The Member assumes the commitment to update his or her Personal Data forms is necessary. The Administrator does not take responsibility for the validity of the Personal Data provided by the Member.

The Administrator reserves the right to suspend any account, weather definitively or temporarily of those Members that by their conduct violate in any way the present Terms and Conditions, without fear of penalty of any type.

The Member, once having completed the indicated recording, will accede to his or her personal account (Account) by means of the entrance of its Nickname (Nick) and personal sign (Password) chosen. The Member is commited to maintain the confidentiality of his or her password. The Administrator will not be responsible if this confidentiality is to be violated.

The Administrator reserves the right to reject any request of recording or to cancel a previously accepted recording, without being forced to communicate or to expose the reasons for his or her decision and without generating any right to indemnification or compensation.

The Member will be notified of the present Terms and Special Conditions properly upon joining dogup.com. Its modifications will always be posted, and can be made at anytime without notifying any Member or User.

The Member can access the same services that are offered to the User and which are described in present Terms and those generally (to put Link) applicable to the User.

Also, according to these Special Terms and Conditions, the Member has more privileges and accesses than the User.

Within the category of Members, the following subgroups will be distinguished:

a)Common Members: Also known simply as Members in these terms.

b)Pet Shop Members: Those are the physical or legal people who are the owners and/or they represent commerce related to the heading pets. Members Pet Shop will be able to offer their products only to the Common Members.

c)Factories Members: They are the physical or legal people who have factories related to the heading pets. These will be able to offer their products only to the PetShop Members.

2.- Service of Finder

The Member, like the User, has the possibility of making two types searchs: by dog and/or by breed.

The search will elicit an obtained result from the data bases of the Administrator. These data bases are composed of information provided by the Members and are collected via the Internet.

The administrator of the dogup.com does not guarantee the exactitude and/or validity of the information contained in the data bases. The information in the data bases is being provided by third parties (members and Internet) and will contain inexact data, incorrect and/or insubstantial or typesetter errors, and consequently, responsibility is not assumed for the veracity nor for inexactitude of this data.

The results that are gleened from the searches, do not constitute an exhaustive list of all the dogs and/or deposits that are on the market, therefore it is not guaranteed that there are not other similar products contained in other data bases and/or in other sites.

The information offered by the search service will have to be viewed objectively and independently by the Member, not assuming dogup.com nor its administrator shall take any type of responsibility for the incorrect, antiquated and/or some form of untruthful information.

Any obligation towards the Member is not assumed, by virtue of the service, and in regards to which dogup.com is only limited to publish, according to the data required in the search by the Member, that information is provided by the Members, or obtained from the Internet, of a form similar to that of a telephone directory.

3.- Service "Dating"

The denominated service "Dating" is a virtual space by means of which people with friendship aims will be able to look and/or be looked for with the a healthy relationship as the common objective.  On the other hand, in agreement with the content of dogup.com, those Members that have canine pets who wish to find a mate for the them will be able to do so by means of this service, indicating the race looked for in the form search, along with the rest of the required data (sex of the applicant, sex of the applicant looked for, lease, age).

The result of the search will allow the Member to analyze the different registered profiles, being able to accede to all of the data of these profiles, with the added possibility of contacting such Members.

The present service, gives the possibility to the Member who registers to create his or her own profile and/or one for his or her dog, so that they can be considered in the different searches that other Members and/or Users perform.

The Member declares him or herself to be of legal age, and he or she gives his or her consent for the created profile to be placed in the corresponding data base as functions the service.

For the creation of a profile, the Member will have to complete the form and the fields that are required of him or her while also declaring the veracity of such.

Also, he or she will be able to place an image and/or photo along with the profile information, to then be scrutinized, authorized and/or discarded based on the best judgement of the Administrator.

The Member will be able to modify and/or to eliminate his or her profile from the service, when he or she considers it necessary to do so, without generating any necessary type of compensation in his or her favor.

Once the wished profile has been found, the Member will be able to collect the data of contact at issue to continue via Internet, to epistolar and/or personnel, outside the scope of the dogup.com.

The administrator reserves the right not to publish those profiles that contain offensive texts and/or texts inaplicable to the purpose of dogup.com, and/or equally unsuitable images and/or that of doubtful responsibility.

The administrator of dogup.com does not take responsibility for the information that the Members indicate in their profile, nor for the success, failure and/or any other result that derives from the use of the present denominated service "Dating.”  The administrator will not be held accountable for any misuse of the service by any type of Member and/or User. It is not guaranteed that the offered contacts are real and/or exact in regards to the desired person or dog.

Due to the impossibility to control the totality of the profiles, the Administrator will not be held accountable for the plagarism or any  violation directly or indirectly of the national laws and applicable international treaties on author rights, trademarks, patents, industrial models and designs made by any type of Member or User. The publication of this type of information in any is prohibited, and all Members who choose to do so will do it under their exclusive responsibility, and further, the Administrator will take no responsibility for these actions.

Also any profile containing prohibited images (nakedness, pornography, mutilations or aberrations of any type) is strictly prohibited and such will be eliminated, as shall anything with connections to such contents and/or images. The same prohibition corresponds for any form of vindication of a crime.  The respect to the people is INDISPENSABLE. Aggressions of any type will not be accepted for any reason. Any contemptuous commentary with respect to race, creed, social condition, religion, etc. will be considered an aggression and will be subject to edition and the author could be sanctioned by the Administrator by means of the elimination of the profile and/or of the Member account, depending on the gravity of the case, and under the exclusive autonomy and decision of the Administrator.

The Administrator of the Site will carry out all removal of any questionable material as soon as is possible, it is impossible to review all the messages.

The Member shall agree not to publish in his or her Profile nor in the messages directed to other Members, abusive, obscene, vulgar, hate mail, threats, sexually explicit, violent, illegal, antiracial, xenophobic, defamatory, discriminatory and/or any other form of material that might break effective laws and/or the present Terms and Conditions. In any case where this type of material might be published, the Administrator, according to his or her own criterion, will have the right to cancel the account of the respective user and/or to inform to the supplier of Access to Internet of the User.

In the same way, the insertion and/or publicity of nonwished (SPAM), and of any type of forwarded information of massive and automatic form is prohibited.

The administrator of the Site does not guarantee the exactitude and/or veracity of the information contained in the data base of the service "Dating", on that which the searchs are made. Because the data base holds information that is provided by third parties(members), the data therin can be inexact, incorrect and/or insubstantial, and/or can contain false images, and consequently, neither the dogup.com nor its administrator assume any type of responsibility for the incorrect, antiquated and/or any other form of untuthful information.

Any obligation towards the User is not assumed, by virtue of the gratuidad of the service, and in regard to which dogup.com is only limited to publicitar, according to the data required in the search by the User, that information provided by the Members.

4.- Shop

In this virtual space of dogup.com, denominated "Shop", pet products are offered for sale, both those that are offered by the PetShop Members and the Factory Members.

The publication consists of the photo, name of the product and the salesperson, and a connection to the Web site of the selling Member, where the Member will be able to purchase the product offered there directly.

Selling Member will refer to any Pet Shop and/or Factory Member that uses the dogup.com site for advirtizing and selling purposes.

All the information that is published in each advirtizment of each product, will have been provided by the Selling Members, PetShop or Factories.

Under no point of view it will be considered the administrator and/or to dogup.com act as the vendor within the confines of the Shop service, limiting their function soley to the publication within dogup.com, in the form asked for by the PetShop Member or Factory Member.

The administrator of dogup.com does not guarantee the existence of the product and/or the exactitude of its characteristics and/or veracity of the supplies that might exist in the Web sites of the respective salespeople (to see point 13 of the present Terms).

The information contained in each advirtisment, of the product being provided by the respective selling Members, can contain inexact data,  can be incorrect and/or insubstantial, or can contain typesetter errors, and consequently, responsibility shall not be assumed by the administrator and/or dogup.com for the veracity, exactitude nor existence of these products and/or salespeople.

The published information, offered by the selling Member (PetShop Member or Factory Member) will have to be object of an independent and own investigation of the Member and/or User interested in the purchase of the product, not assuming that dogup.com nor its administrator will take any type of responsibility for the incorrect, antiquated and/or any other form of untuthful information.

Any obligation towards the Member is not assumed, and in regard to which dogup.com is only limited to publicize the information provided by the selling Members, of a form similar to that of a telephone directory.

5- Media

The Web site design, logo, screen saver, and e-card and personal card services will be governed according to the conditions that are published in "Media" the virtual space of the Site.

The described price of each one of the services in the previous paragraph, will be determined by the Administrator.

The promotions, conditions and/or prices that will be published  always have temporary character, reserving to the administrator the right to modify them in any term and under any circumstance. The Members will not be able to impute responsibility to the administrator or the site or to demand payment and/or indemnification by the modification of the promotions, conditions and/or prices of the services indicated in this point. Also, they will not be able to demand the fulfillment of those promotions, prices and/or conditions previous to the effective ones.

The generic Members will be able to download freely screen savers and also, to send e-cards.

The administrator and/or the Site will not take responsibility for the damages of any type, that might be caused by free downloading, or the delivery of e-cards mentioned above, by virtue of the risk assumed according to the arranged thing in point 11 of the present terms.

6.- Adversiment

a) Finder

In the finder of deposits referred to in point 2, the Members that offer their puppies for sale, or they want to publicitar its deposits, they will be able to make it previous payment of the canon determine in each situation by the Administrator and/or dogup.com.

Different prices will be offered, allowing the maximum of which will grant the Member a space within the first five (5) results that the Service search of point 2 will give as a responce, with the possibility of placing a photo of the dog next to the heading.

These positions rotate dayly, in order to allow each Member to occupy a different place in the listing to ensure that everyone´s posting be seen.

b)Banner

Those Members that wish to place an advertising banner in dogup.com will be able to do so adjusting it to the conditions and prices that the Administrator determines, the one that public in the lapel will do "Publicity" of dogup.com.

c)Banner Text

They are different from the previous ones in the sense that a text with the product is only published that offers the Member, and the connection to the Web site of this last one, where it will be possible to be acceded to more information.

All the published information that through anyone of the three service discriptions in points a), b) and c), will be provided by the Members.

Under no point of view will it be considered of the administrator and/or of the Site that they are the vendors, limiting his or her function to the publishing of the advirtisments on dogup.com, in the form asked for by the Member.

The administrator of the Site does not guarantee the existence of the product, the exactitude of its characteristics and/or veracity of its supplies that might exist on the Web site of the respective salesperson (to see point 13 of the present Terms).

The information contained in each advirtisment being provided by the respective selling Members, can contain inexact, incorrect, and/or insubstantial data or typesetter errors, and consequently, responsibility is not assumed by the administrator nor dogup.com for the veracity, exactitude nor existence of these products and/or salespeople.

The published information, offered by the Member will have to be object of an independent and own investigation of the Member interested in the purchase of the product, not assuming that dogup.com nor its Administrator will hold any type of responsibility for the incorrect, antiquated and/or any other form of untuthful information.

By virtue of all of the exposed one, the administrator and/or dogup.com do not take responsibility for any damage or loss that the Member might suffer because of the breach of the salesman of  the product.

The Members will not be able to impute responsibility to him some or to demand payment andor indemnification by any cause, and much less by damages than they could be from the breach of the selling Member.

Any obligation towards the Member is not assumed, and in regard to which dogup.com is only limited to publish the information provided by the selling Members, of a form similar to that of a telephone directory.

The price and conditions of the services will be determined by the Administrator, the one that public in the lapel will do "Publicity" of dogup.com.

The promotions, conditions and/or prices that will be published in relation to anyone of the indicated services of publicity in this point will always have a temporary character, reserving to the administrator the right to modify them in any term and under any circumstance.

The Members that contract the service, will not be able to impute some responsibility to the administrator or to demand payment and/or indemnification by the modification of the promotions, conditions and/or prices of the service indicated in this point.

Also, they will not be able either to demand the fulfillment of those promotions, prices and/or conditions previous to the effective ones.

7.- Puppies

The propietary members of puppies, will be able to offer the sale of such through this one service, through a monthly payment.

This installment will allow the publication of up to five (photos) of the puppy individualy, along with the information of him or her.

The Member interested in the purchase of the puppy, will be able to be contact the selling Member, by means of a contact form, so that in a private form they will be able to correspond.

All of the published information provided throught this service is that of the proprietary Members of the puppy for sale.

Under no point of view will be considered of the administrator and/or of dogup.com a salesperson or store, limiting its function the publication of the advirtisment on dogup.com, in the form asked for by the Member.

The administrator of dogup.com does not guarantee the existence of the product, the exactitude of its characteristics and/or veracity does indeed exist in the Web site and/or possesion of the respective salesperson (to see point 13 of the present Terms).

The information contained in each advirtisment, to the being provided by the respective selling Members, they can contain inexact data, incorrect andor substantial or typesetter errors, and consequently, responsibility is assumed some by the veracity neither exactitude nor existence of these products and/or salespeople.

The published information, offered by the Member it will have to be object of an independent and own investigation of the Member interested in the purchase of the product, not assuming dogup.com nor its administrator have any type of responsibility for the incorrect, antiquated, and/or any form of untruthful information.

By virtue of all of the exposed one, the administrator and/or dogup.com will not take responsibility for any damage or loss that the Member will be able to suffer because of the breach of the salesperson of the product.

The Members will not be able to impute some responsibility to him or to demand payment and/or indemnification by any cause, and much less by damages that could result from the breach of the selling Member.

The price and conditions of the service will be determined by the Administrator, the one that public in the lapel "Puppies" will do of dogup.com.

The promotions, conditions and/or prices that will be published, always have temporary character, reserving to the administrator the right to modify them in any term and under any circumstance.

We are a listing of breeders and private dog owners ONLY.  Dogup.com promotes the recognition that small (at times BIG!) lives are not to be sold as ‘products’ on shelves.  In an effort to deter Puppy Mills from using our site, the posting of more than two breeds per user will not be allowed.

The Members will not be able to impute some responsibility to the Administrator or to demand payment and/or indemnification by the modification of the promotions, conditions and/or prices of the services indicated in this point. Also, they will not be able either to demand the fulfillment of those promotions, prices and/or conditions previous to the effective ones.

8.- Payments

Any payment that is made by virtue of the different services that are offered will be made on the matter through dedicated companies, reason why at no moment the Member will directly grant the data of its credit card to the Administrator nor to dogup.com.

A data base with the payments made by the Members will not form by virtue of the exposed thing in the previous paragraph.

Once credited the same one on the part of the Administrator, the Member will be able to accede to the paid service.

9.- Use of dogup.com

The User is not authorized to copy, to distribute or to redistribute, either gratuitous or onerous, the images, the news and really any data that is in dogup.com, assuming all responsibility by its breach towards the Administrator and/or any third party who is affected.

In the case that the User wants to obtain the licenses, rights and/or trademarks, he or she will have to contact the Administrator of dogup.com via email, to make his or her request.

10.- Modifications

The Administrator of dogup.com will be able to modify the General Terms and Conditions at any time, making them public in the Site with no need notify.

Also, as outside expressed in the point (1), the single use of dogup.com on the part of the User, indicates consent with the present Terms and their modifications.

11.- Faults in the system

The Administrator does not take responsibility for any damage to the User inflicting casualties by faults in the system, in the server or Internet. The Administrator by any virus will not be responsible either that could infect the team of the User as a result of the access, use or examination of dogup.com or as a result of any data transfer, archives, images, texts, or audio contents in such. The Users will not be able to impute some responsibility to the Administrator or to demand payment and/or indemnification by any cause, by virtue of resulting damages of technical difficulties, faults in the systems, in the Internet and/or in dogup.com.

The Administrator does not guarantee access to dogup.com and/or to the internet and their usibility to be continuous or uninterrupted. The system might not be available due to technical difficulties or faults of the Internet, or by any other circumstance. In such cases the accessability and usibility will be restored with the greatest possible speed. without for that reason it can impute to the administrator some type of responsibility. The Administrator will not be responsible for any error or omission contained in dogup.com.

12.- intellectual Property.

This site is owned and operated by Dogup.com and contains material which is derived in whole or in part from material supplied by dogup.com and other sources. The material on this site is protected by international copyright and trademark laws. Dogup.com is a registered trademark of Dogup.com. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way any material from this site including code and software. You may download material from this site for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices.

The material published in the section "the News" is of property of its authors who have granted the had license to publish this material in dogup.com.

In particular relation to all of the images published that have been provided to dogup.com and all of its different componants, have been provided by the Members, who have declared to be their authors and grant through the present, the respective license of use to the Administrator of dogup.com, or they have declared to have the corresponding license of use of the author to be able to publish it in dogup.com.

The Member will have a virtual space denominated "Shared Photos", in which he or she will be able to place the images of him or herself and/or his or her pet, previous authorization of the Administrator. These images could be seen by any User and/or Member.

In the possible case that the authors rights are being violated, the Member and/or affected User will have to inform the Administrator of dogup.com of the possible transgression, who will take the necessary measures, in that case.

The Administrator does not take responsibility for the material published that breaks directly or indirectly the national laws and applicable international treaties or author rights, trademarks, patents, industrial models and designs. The Members who publish any type of material will do it under his or her exclusive responsibility, considering the prohibitions of these Terms and Conditions.

The programs, data bases, networks, archives, of dogup.com, that the User might use are of property of the Administrator and are protected by the national laws and international treaties of author right, trademarks, patents, industrial models and designs. The illegal use and the total or partial reproduction of these contents are prohibited, except for when authorization of it has been granted in writing and of its author.

The Administrator authorizes to the User the use of the rights of intellectual and industrial property relative to the installed computer science application in the server of dogup.com, that it executes the benefits that compose it, to solely use them according to the established thing in these General Conditions. The Administrator does not grant any other license or authorization of use of any class on his rights of intellectual and industrial property or on any other property or right related to dogup.com.

13.- Links

Dogup.com can contain connections to other Web sites which does not indicate that they are property or operated by the Administrator, and by virtue of which it does not have control over such sites. The Administrator will not be responsible for the contents, materials, actions and/or served by such, nor by damages or casualties inflicted by the use of such, weather they be caused directly or indirectly. The presence from connections to other Web sites does not imply a society, relation, approval, endorsement of the Administrator to these sites and their contents.
